What information we collect

Depending on how you use the shop, we process your name, email address, telephone number, billing and delivery address, order history, payment confirmation and transaction references, returns and customer-service records, product reviews, newsletter preferences, search and browsing activity, device and cookie information, and information you choose to send us in chat or forms. Payments are processed through Shopify and the relevant payment providers: we do not receive or store your complete payment-card details.

How and why we use your information

  • Orders, payment, delivery and returns: to process purchases, deliver goods, handle refunds and provide customer service. Legal basis: performance of a contract or steps requested before entering one.
  • Accounting, tax, legal compliance and consumer-rights obligations: to keep legally required records and respond to valid requests. Legal basis: legal obligation.
  • Store operations and security: to protect accounts, prevent fraud, maintain stock accuracy, respond to enquiries, understand website performance and improve our services. Legal basis: legitimate interests, balanced against your rights; where required, consent applies to non-essential tracking.
  • Newsletters, new-arrival notifications and promotional marketing: when you sign up or where otherwise permitted by law. Legal basis: consent or, where its conditions are met, the applicable direct-marketing rules and legitimate interests. You can unsubscribe at any time. Transactional order messages are separate from promotional emails.
  • Personalisation and advertising: where enabled, to measure marketing, show relevant recommendations or ads and improve shopping experiences. We obtain cookie or advertising consent where required and respect available privacy choices.

Services and apps we use

We use Shopify to host the store, checkout, orders, customer accounts and related services. The following installed integrations may process relevant information when their features are enabled and used:

  • Crosslist: synchronises product, stock and marketplace listing information, with relevant order or fulfilment data where needed to prevent items selling twice.
  • Searchanise Search & Filter: provides on-site search and product filtering and may analyse search interactions to improve results.
  • Shopify Messaging / Inbox: supports customer enquiries, chat and email communications.
  • AI-assisted chat through Shopify Inbox: When you use our website's chat assistant, Shopify processes your chat communications and information you choose to share (for example, clothing preferences or sizing questions) to generate replies and improve the quality of the Inbox agent over time. Relevant product, store policy and available customer information may be used to provide answers and recommendations. Our team may review conversations to provide support and improve service. Shopify displays a notice when you are chatting with AI. You can request human assistance. Please do not enter payment card details or passwords in chat.
  • Shopify Forms: collects details and preferences that you submit through newsletter or other site forms.
  • Shopify Flow: automates store operations using relevant order, inventory or customer data already held in Shopify.
  • Judge.me Reviews: may process order and contact details to request, collect, verify and display customer reviews, subject to the settings we enable.

We also share only necessary information with payment processors, shipping companies, IT or hosting providers, fraud-prevention services, accountants and professional advisers where required. If we later activate other marketing platforms, tracking pixels or review tools, we will review this notice and consent settings accordingly. App providers may have their own privacy notices.

Cookies and tracking

Essential cookies make the storefront and checkout function. Optional analytics, personalisation and advertising cookies or similar technologies are used only in accordance with applicable consent requirements. You can manage available choices through the site's cookie banner or Your Privacy Choices. Withdrawing consent does not affect the lawfulness of processing before withdrawal.

Shopify's processing and network features

Shopify processes information to provide the shop and may use data across participating stores for enhanced services where enabled, subject to applicable consent choices. Read the Shopify Consumer Privacy Policy and visit Shopify's Privacy Portal to understand and exercise rights that apply to Shopify's own processing.

Overseas transfers

Some of our service providers may process or access information outside the United Kingdom. Where required, we rely on appropriate safeguards such as UK adequacy regulations, the UK International Data Transfer Agreement or the UK Addendum to standard contractual clauses. Contact us to request further information about applicable safeguards.

How long we keep information

We keep order, transaction and accounting records for as long as necessary to meet relevant legal requirements, ordinarily up to six years or longer where a legal obligation or dispute requires it. We keep support messages, reviews, account information and marketing preferences only as long as reasonably necessary for the purpose collected, subject to legal obligations, user requests and operational needs. Unsubscribed addresses may be retained on a suppression list to prevent further unwanted marketing.

Your rights

Depending on applicable law, you may request access, correction, deletion, restriction, data portability, or object to processing, including direct marketing. You may withdraw consent where consent is our legal basis. We may need to verify your identity and can decline or limit a request where law permits or requires it. Email pastandpresentlimited@gmail.com. You may also complain to the UK's Information Commissioner's Office (ICO).

Children and changes

Our store is intended for general shoppers and is not directed at children. We may update this notice when our services, apps or legal obligations change. The updated version will be posted here with a revised date.
